RULES AND GENERAL TERMS OF PARTICIPATION IN THE PRIZE GAME

The organizer of the prize draw is Pos plastika d.o.o., Podgorska cesta 30, 1317 Sodražica (hereinafter referred to as the organizer).

1. TERMS OF PARTICIPATION

The prize draw is open to adults with permanent or temporary residence in the Republic of Slovenia. Persons under the age of 18 must have the prior written consent of their parents or legal guardians to participate in the prize draw.

Purchase is not a condition for participation in the prize game.

Participants in the prize game themselves cover all costs of participation in the prize game, which include: the cost of internet access, the cost of data transfer from the internet.

Employees and their family members or external contractors and their immediate family members may not participate in the prize game.

Each individual may only participate in each prize game once.

The prize game is in no way affiliated with, sponsored, supported or organized by Facebook. All data and information required for participation in the prize game will be forwarded to the organizer, and in no way to Facebook. The organizer is solely responsible for the content of the prize game.

Participation in the prize game means that the participant accepts all general terms and conditions of participation in the prize game stated here and the conditions published on the Facebook profile.

2. RULES OF THE CONTEST

The contest is held on the social networks Facebook, Instagram or on the organizer's website.

The organizer will select the participant who receives the prize by drawing lots.

In the event of incomplete, incorrect or untrue information, the organizer reserves the right to prevent the participant from participating in the contest or to exclude him/her from the contest.

The participant loses the right to the prize if the organizer determines that:

• the participant did not meet the conditions of participation;
• the participant violated the rules and conditions of participation in the contest;
• the participant does not want to fulfill the obligations in accordance with these terms or special terms published on the Facebook profile or did not fulfill them on time;
• in the case of applications: if the application is inadequate in any way.

In the event that a participant loses the right to a prize, the organizer will decide whether to award the prize to someone else or not.

If the terms of the prize game stipulate that the participant submits sketches, drawings, photographs, video recordings or other copyrighted material in order to participate in the prize game, by submitting the material, the participant guarantees to the organizer that he/she has all material copyrights on this material and transfers them in full once and for all to the organizer of the prize game.

By submitting the material from the previous paragraph, the participant gives irrevocable consent to the publication, exhibition, printing, distribution, etc., in part or in whole, without restrictions regarding transformations or processing of the material, in all media (printed media, on websites, Facebook profiles, advertising editions or other media) of the organizer or co-organizer of the prize game without the right to compensation or payment. At the same time, he/she waives the right to review, approve and object to any method of use of the material, editorial choice or appearance of the material.

In the event that the participant is drawn or selected as a winner, by accepting the prize, he/she gives irrevocable consent to cooperate with the organizer or co-organizer in the sense of photographing the winner for the purposes of advertising or publishing the material thus obtained in all media (printed media, websites, Facebook profiles, advertising editions or other media) of the organizer or co-organizer of the prize game, without the right to compensation or payment. At the same time, he/she waives the right to review, to review, approve and object to any method of use of the material, editorial choice or appearance of the material.

3. PRIZES

The type and description of the prizes are presented in the text of the prize game announcement on the social networks Facebook, Instagram, the website or where the prize game is also taking place.

The prizes are not exchangeable for another type of prize, payable in cash or transferable to third parties.

4. ANNOUNCEMENT OF THE WINNER

The winner will be announced on the day specified in the description of the prize game on the website and/or Facebook profile, but no later than 14 days after the end of the prize game at the organizer's headquarters

5. NOTIFICATION OF PRIZE WINNERS

The winner will receive notification of the prize via a private message on their Facebook profile.

By participating in an individual prize game, the participant agrees that in the event of a draw, the organizer will publish them as the winner on the Facebook profile wall, website and also tag them ("tag").

The list of winners will be published on the website and/or Facebook profile no later than three days after the prize draw.

The results of the prize game are final. They cannot be appealed.

6. PRIZE COLLECTION

As a prize winner, the participant is entitled to collect the prize if the organizer or the administrator of the website and/or Facebook profile informs him/her about the prize within the agreed deadline.

Prizes are taxed according to the Income Tax Act. The winner is liable to pay income tax in accordance with the Income Tax Act (other income, which also includes prizes). The advance income tax is calculated and paid by the organizer of the prize game, which provides the prize.

To collect the prize, the winner must submit the following personal data upon written request from the organizer: name and surname, exact permanent address, place of residence, tax number and tax office. For the purpose of informing about the collection of the prize, the winner must also provide a contact telephone number.

If the winner fails to submit the required information within seven days of the date of the invitation, he/she loses the right to the prize without any compensation.

The organizer shall inform the winner of the method of accepting the prize by means of a written invitation referred to in the third paragraph of this article.

In order to accept the prize, persons under the age of 18 must submit to the organizer the written consent of their parents or legal guardian at the same time as submitting the information referred to in the third paragraph of this article, and no later than by the time the prize is accepted. The written consent may be drawn up by the parents or legal guardians themselves.

7. PROTECTION OF INFORMATION AND PERSONAL DATA

The organizer Pos plastika d.o.o., Podgorska cesta 30, Sodražica, as the controller of personal data, respects the privacy of the participants of the individual prize game and undertakes to handle the personal data obtained during the prize game with care and to protect and process them in accordance with the Personal Data Protection Act.

Without the express consent of the participants of the individual prize game, the organizer will not forward the personal data of the participants to a third party or use them for purposes other than exclusively for the needs of the successful comprehensive implementation of the prize game.

The organizer does not assume any responsibility for the protection of data on websites to which certain links on the organizer's websites lead, nor does it assume responsibility for any errors that may occur when incorrect or false data is provided by the participants of the prize game.

The participant of the prize game allows the organizer, as the controller of the personal data collection, to keep, maintain and process the collection of personal data provided for the purposes of the prize game in accordance with the Personal Data Protection Act until the participant withdraws or until the purpose of the data processing is fulfilled.

The organizer stores the data in computer form. After the need for data management ceases or upon the request of the winner, the data is deleted.

The data users are the administrators of the website and/or Facebook profile and are responsible for the delivery of prizes.

8. FINAL AND TRANSITIONAL PROVISIONS

Along with the Prize Game Terms and Conditions, the participants of the prize game also accept the terms and conditions and rules of the Facebook community. The organizer does not assume any responsibility for failure to comply with the terms of use of the Facebook community by the participants of the prize game. Nor does it assume any responsibility for any consequences resulting from the publication of contributions on the Facebook profile.

The organizer reserves the right to amend and change the terms and conditions of the prize game, if required by technical or commercial reasons or reasons on the part of the public.

The organizer will keep participants informed of all changes and news of the prize game by posting on the website and/or Facebook profile.
